Terms of Service
These terms are a contract between you and us. Please read them. The short version: your work stays yours, you only upload what you have the right to publish, and we provide Semirare as it is, with our liability limited as far as the law allows.
1. Who we are
Semirare (“Semirare”, the “Service”) at semirare.com is operated by Initial condition s.r.o., Urxova 436/10, Karlín, 186 00 Prague 8, Czech Republic, company ID (IČO) 10953035, VAT ID CZ10953035, registered in the Commercial Register of the Municipal Court in Prague, file C 351251 (“we”, “us”, “our”).

2. Agreement and eligibility
By creating an account, publishing a portfolio or otherwise using Semirare you agree to these Terms of Service and to our Privacy Policy. If you don’t agree, don’t use the Service.
You must be at least 16 years old to create an account. If you use Semirare for a company, studio, gallery or other organisation, you confirm that you may bind it to these terms, and “you” includes that organisation.
Visitors to portfolios hosted on Semirare may use them without an account. Sections 7, 13, 14, 15 and 18 also apply to them.
3. The service
Semirare lets you upload images and text, arrange them into works and collections, choose a theme and publish a portfolio website on a semirare.com address or on your own domain. It includes a contact form that forwards messages from visitors to you, and an export of your content.
Semirare is a hosting tool. We don’t review, curate or endorse what users publish, and we are not a party to anything agreed between a portfolio owner and their visitors, clients or buyers.
4. Your account
- Give us a working email address that you check. We send important notices there.
- Keep your password secret. You are responsible for everything done through your account.
- Tell us straight away at [email protected] if you think someone else has access to it.
- One person or organisation per account. Don’t create accounts in bulk or by automated means, or to get around a suspension.
5. Your content and copyright
“Your content” means everything you upload or enter: images, titles, descriptions, texts, your name, logo and links.
Your work stays yours. We don’t claim any ownership of your content.
You may only upload content you have the right to publish. By uploading content you confirm that:
- you created it, or you hold all licences, permissions and releases needed to publish it on a public website, including from photographers, models, clients, collaborators and anyone who can be recognised in it;
- publishing it does not infringe anyone’s copyright, trademark, design, privacy, personality or other rights, and does not breach any contract or confidentiality obligation;
- it complies with these terms and with the law of the Czech Republic and of the country where you live.
Uploading other people’s copyrighted work without permission is prohibited. This includes other artists’ work presented as your own, stock photographs you haven’t licensed, film stills, scans of books and magazines, and work you made for a client who has not allowed you to show it. We remove such content when we learn of it and close the accounts of repeat infringers.
You are solely responsible for your content and for any consequences of publishing it. Keep your own copies of everything you upload (see section 11).
6. What you allow us to do with your content
To run the Service we need your permission to handle your content. You grant us a worldwide, non-exclusive, royalty-free licence, for as long as your content is on Semirare, to store, copy, back up, resize, convert, cache and display it, and to make it available to the public on your portfolio, only as needed to provide, secure and improve the Service for you.
If you choose to keep your portfolio public, you also allow us to show it, with a link and credit to you, in Semirare’s own theme previews, examples and marketing. You can ask us to stop at any time and we will, within a reasonable time.
We do not sell your content, and we do not license it to anyone to train artificial intelligence models. We don’t use your images to train AI models ourselves.
The licence ends when you delete the content or your account, except for copies in backups, which are deleted on their normal schedule (see our Privacy Policy), and copies we must keep by law or to deal with a dispute.
7. Acceptable use
Semirare is for showing creative work. You must not use it, or let anyone use your portfolio, to publish, send or do any of the following:
- content that infringes copyright, trademarks or other intellectual property rights;
- sexual content involving minors, in any form, real or generated; we report it to the authorities;
- pornography or sexually explicit material. Artistic nudity is allowed, for example in painting, drawing, sculpture or photography, as long as it is not explicit;
- intimate images of anyone without their consent, or anything that harasses, threatens, stalks, bullies or doxxes a person;
- hate speech, or content that promotes violence, terrorism, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or similar grounds;
- images of identifiable people used in a way that violates their privacy or personality rights;
- deceptive content: impersonating another person or brand, phishing, scams, fake shops, fake reviews, or pages that collect passwords or payment details;
- malware, crypto-mining scripts, or links to either;
- spam, including using the contact form, our emails or your portfolio to send bulk or unsolicited messages;
- sale or promotion of illegal goods or services, weapons, drugs, or gambling;
- file hosting unrelated to a portfolio, such as using Semirare as a download site, image CDN or backup service;
- anything else that is illegal in the Czech Republic or the European Union.
You also must not:
- probe, scan or test the vulnerability of the Service, or break or bypass any security or access control, except through responsible disclosure to [email protected];
- overload the Service, or access it by scraping, crawling or other automated means beyond what an ordinary search-engine crawler does, or collect other users’ data;
- copy, decompile, reverse engineer or resell the Service, its code or its themes, or build a competing product from them;
- remove or hide the “Made with Semirare” link by technical means.
We decide, reasonably and in good faith, whether content or conduct breaks these rules. When it does we may remove or hide the content, restrict features, or suspend or close the account, as described in section 12.
8. Reporting illegal or infringing content
If you believe something on a Semirare portfolio infringes your copyright or other rights, or is illegal, email [email protected]. This is also our single point of contact for users and for authorities under the EU Digital Services Act; you can write to us in English or Czech. Please include:
- the exact address (URL) of the content;
- what you believe is wrong with it and why, with enough detail for us to assess it without a legal examination; for copyright, identify the original work you own;
- your name and email address (not required for reports of child sexual abuse material);
- a statement that you believe in good faith that the information in your notice is accurate and complete.
We confirm receipt, review the notice promptly, and tell you what we decided. If we remove or restrict content, we tell the portfolio owner why, and they can reply to the same address to contest the decision; we review it again. Knowingly false notices may make the sender liable for the harm they cause.
9. Addresses and domains
Your semirare.com address (for example yourname.semirare.com) is provided for use with the Service; it is not your property. We may refuse or reclaim an address that is misleading, infringes a trademark or someone’s name, is reserved, or belongs to an account that has been closed.
If you connect your own domain, you must own it or have the right to use it, and you remain responsible for registering, renewing and paying for it with your domain registrar. We are not responsible if the domain expires, is misconfigured, or stops pointing to Semirare.
10. Plans, payment and refunds
Semirare has a Free plan and a paid Pro plan. Current plans, limits and prices are listed on our pricing page.
Paddle is our reseller. Paid plans are sold by Paddle.com Market Limited (“Paddle”) as merchant of record. Paddle processes your payment, issues your invoice, charges any VAT or sales tax, and handles billing questions and refunds. Paddle’s buyer terms apply to your purchase in addition to these terms.
- Renewal. Paid plans renew automatically at the end of every billing period (monthly or yearly) until you cancel. You can cancel at any time in your settings; your plan then stays active until the end of the period you have already paid for.
- Refunds. Except where the law or Paddle’s terms require otherwise, payments are non-refundable, including for partly used periods and for periods in which you did not use the Service.
- Right of withdrawal. If you are a consumer in the EU, you have 14 days to withdraw from a purchase. By starting to use Pro features straight away you ask for the service to begin during that period; if you then withdraw, you may get a refund reduced in proportion to the time already used, as the law allows.
- Price changes. We may change prices. We tell you at least 30 days before a new price applies to your next renewal, and you can cancel before then.
- Downgrades and failed payments. If a paid plan ends or payment fails, your account moves to the Free plan. Works above the Free plan’s limit are hidden from your public site but not deleted, so nothing is lost if you upgrade again.
- Free plan. The Free plan is provided without payment and may be changed, limited or discontinued at any time with reasonable notice.
11. Availability, changes and backups
We work to keep Semirare fast and online, but we don’t promise that it will be available at all times, uninterrupted or free of errors. We may carry out maintenance, and the Service depends on third parties (hosting, storage, email, payment and domain providers) that can fail.
Semirare is an evolving product. We may add, change or remove features, themes and limits at any time. If we remove something that is a significant part of a paid plan, we tell you in advance and you may cancel; if you have paid for a period in advance, you may ask for a pro-rata refund of the unused part.
Semirare is not a backup service. We make reasonable technical efforts to protect your files, including backups of originals, but you are responsible for keeping your own copies of everything you upload. You can download all your content at any time in Settings → Your data.
12. Suspension, termination and deletion
By you. You can close your account at any time in Settings. Closing it deletes your portfolio and content (see the Privacy Policy for backups). Export your content first if you want to keep it.
By us. We may remove content, restrict features, or suspend or close your account, with or without notice, if:
- you break these terms, especially sections 5 and 7, or we receive a credible notice that your content is illegal or infringing;
- we must by law or by order of an authority;
- your account puts the Service, other users or us at risk, including legal risk;
- a Free account has been inactive for more than 24 months (we email you first);
- we stop offering the Service, in which case we give at least 60 days’ notice so you can export your content, and refund any prepaid period that we don’t provide.
Where we act on your content or account, we tell you the reason, unless the law forbids it or it would help someone cause harm. If we close your account for a serious breach, you are not entitled to a refund. Sections 5, 6 (for copies we lawfully keep), 13 to 19 survive the end of this agreement.
13. Our property
The Service, its software, design, themes, logos, texts and the name Semirare belong to us or our licensors and are protected by law. These terms give you only a limited, personal, non-transferable, revocable right to use the Service as intended. You may not copy our themes or code for use elsewhere. If you send us ideas or feedback, we may use them freely, without any obligation to you.
14. Service provided “as is”
To the fullest extent permitted by law, Semirare is provided “as is” and “as available”, with all faults and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or that your content will be kept, displayed correctly or found by search engines.
We don’t guarantee any result from using Semirare, such as visitors, enquiries, commissions or sales. You use the Service at your own risk. Portfolios are made by their owners; we are not responsible for their content or for any dealings with them.
15. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, business, commissions, goodwill, reputation, data or content, or for the cost of replacement services, however caused and even if we were told they were possible;
- we are not liable for content published by users, for the acts of visitors or third parties, or for failures of third-party services, networks or domains outside our reasonable control, or for events of force majeure;
- our total liability for all claims arising from or related to the Service or these terms is limited to the amount you paid us for the Service in the six (6) months before the event giving rise to the claim, or 50 euros if you paid nothing.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, in particular liability for harm caused intentionally or through gross negligence, and for harm to a person’s life, health or other natural rights. If you are a consumer, these terms don’t take away any rights you have under mandatory consumer protection law, including your statutory rights if the Service is not provided as agreed.
16. Indemnity
You will compensate us, and defend and hold harmless our company, its owners, employees and contractors, against all claims, damages, fines, losses and costs (including reasonable legal fees) brought by third parties or authorities that arise from your content, your use of the Service, your breach of these terms, or your infringement of anyone’s rights. We will tell you about such a claim and may take part in its defence with our own counsel. If you are a consumer, this applies only to the extent you are at fault.
17. Changes to these terms
We may update these terms, for example when we change the Service or when the law changes. For significant changes we tell you by email or in your dashboard at least 30 days before they take effect. If you don’t agree, you can close your account before then; if you had prepaid for a period, you may ask for a pro-rata refund of the unused part. If you keep using Semirare after the changes take effect, you accept them. The date at the top shows the current version.
18. Governing law and disputes
These terms are governed by the law of the Czech Republic, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The courts of the Czech Republic, with local jurisdiction in Prague, have exclusive jurisdiction over any dispute.
If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring a claim in its courts. Consumers can also use out-of-court resolution with the Czech Trade Inspection Authority (Česká obchodní inspekce, adr.coi.cz). Please contact us first; most things are sorted out with an email.
Disputes must be brought individually. To the extent permitted by law, you waive the right to bring or take part in a class or representative action against us.
19. Other terms
- These terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If a provision is invalid, the rest stays in force, and the invalid part is replaced by a valid one that comes closest to its purpose.
- If we don’t enforce a right straight away, we haven’t waived it.
- You may not transfer your account or these terms to anyone without our consent. We may transfer them to a company that takes over Semirare, and we will tell you if we do.
- We may send you notices by email or in your dashboard. Transactional emails about your account aren’t marketing and you can’t opt out of them while you have an account.
- These terms are written in English. If we provide a translation, the English version prevails, unless consumer law says otherwise.
